Membership terms and conditions

§1 MEMBERSHIP

Your membership is personal and cannot be transferred to, shared with or used by others. In case of doubt, FamFit may ask to see identification. Please notify us of changes in personal data such as name, address and date of birth by e-mail to info@famfit.dk.

§2 MEMBERSHIP CONDITIONS

FamFit can change the membership terms with a 45-day notice. In the event of a change, we will inform you to the e-mail address you entered when joining FamFit.

§3 DURATION/MEMBERSHIP

The DIBS agreement (the “Free Training” membership and the “Training after use” membership) is an ONGOING membership with automatic payment every 1st of the month. The memberships continue until terminated by one of the parties in accordance with §4. A cash purchase such as our voucher product cannot be terminated, but ends automatically when the voucher is used up or the period expires (24 months from the purchase date for vouchers). For whatever reason, no full or partial refunds will be given for prepaid memberships or products.

§4 TERMINATION/AMENDMENT/REVOCATION

The notice period for DIBS membership is the current month (no later than the last weekday before 16.00). This means that if you unsubscribe from FamFit for example d. 02. in a given month, your membership will expire at the end of the month. Similarly, your membership will expire at the end of the month (no later than the last business day before 16:00) if you unsubscribe on the 28th of a given month and so on.

If you want to change your membership type, it follows the same rules as above. Unfortunately, you can NOT manually make this change in My FamFit.

You must send the termination or change in writing to FamFit by e-mail to info@famfit.dk from the same e-mail address that you are registered with FamFit. In the email, you must include your full name and membership number in addition to your termination/change. The termination is valid from the date of receipt. If there is any doubt as to whether a membership has been terminated, you must be able to prove that a termination has indisputably taken place with a copy of your e-mail termination. So remember to save your resignation ;-).

Finally, please note that memberships and products can NOT be discontinued during the agreed period.

§5 PRICE CHANGES

FamFit reserves the right to make price changes. Such changes will be notified by e-mail no later than 45 days before the price changes take effect.

§6 AVAILABLE SEATS

FamFit cannot guarantee availability in the classes created, as classes are filled on a first come, first served basis.

§7 ATTENDANCE & CANCELLATIONS

Please arrive at least 5 minutes before the start of the class so that we can start the class on time. When you arrive, please state your name and the instructor will check you in via our app.

If a member is prevented from using a class reservation, they must cancel the reservation no later than 2 hours before the start time. If a member; 1) does not cancel a class reservation on time or does not show up at the class no later than 5 min. before the start of the class or 2) fails to cancel no later than 2 hours before the start of the class when the member has been on the waiting list and participation has been confirmed by FamFit, the member will be charged a fee at the applicable rate. If a fee is not paid, FamFit has the right to cancel the membership without notice. Fees are stated in Prices under “Other prices”.

Class cancellations must be made via “booking” on My FamFit no later than 2 hours before the class starts. Also remember to delete yourself from any waiting list within the same deadline if you no longer wish to participate in the class.

In case of late cancellation, late arrival or no-show, it is not possible to get a refund for the canceled lesson.

§8 VALUABLES

Valuables should be considered to be left at home – or brought along so you can carry them with you during training. Unfortunately, FamFit cannot guarantee against loss due to theft or property damage.

§9 RESPONSIBILITY

All training is at your own risk. As a member of FamFit, you are responsible for being in a state of health that allows participation. If in doubt, you should consult your doctor, who is also very welcome to contact us for more information about our approach to training. FamFit does not take responsibility for personal injuries resulting from accidents in connection with the training.

§10 HOLDING TENDER

FamFit has the right to continuously change the number of classes offered. The number of classes depends on the number of members.

§11 CLASS CANCELLATION & CHANGE OF INSTRUCTOR/CLASS TYPE

FamFit reserves the right to cancel classes or change instructor/class type on the same day no later than 1 hour before the scheduled start of the class. The reason will typically be illness of the instructor, where we will of course do everything possible to fill the class with another instructor. The reason may also be too few participants.

§12 RIGHT OF WITHDRAWAL

When buying online, you generally have a 14-day right of withdrawal. However, if you choose a start date that is within 14 days, please note that the right of withdrawal expires on the start date.

§13 QUITTING

The receipt for the purchase will be sent to the e-mail address entered. Please note that you are responsible for ensuring that the information entered is correct.

§14 CRITERIA FOR SUBSCRIPTION FEATURES

Before a debit card withdrawal can occur, the card details must match Nets’ card database. The payment card must be active and it must be possible to complete a transaction on the subscription amount. The payment card used for subscription withdrawals must be able to make transactions online.

§15 LATE PAYMENT

If the current payment for a DIBS membership is not paid at the agreed time, a reminder letter will be sent to you and a reminder fee will be charged at the applicable rate. If you do not pay within 10 days of the stated due date, FamFit has the right to cancel the membership without notice, and FamFit reserves the right to charge the amount immediately for the remainder of the relevant payment period. Your membership will also be blocked until payment of FamFit’s outstanding balance has been made. After payment, you can rejoin FamFit’s classes until the end of the relevant payment period.

§16 UPDATING MAP DATA

Card data can be updated by logging in to the online booking, My FamFit, and selecting “User profile” – “Authorize payment card”. By contacting FamFit, card details can be renewed or deleted. You are responsible for ensuring that your card data is correct at all times. If this is not complied with, FamFit may inactivate/terminate the membership without notice.

§17 FAMFIT'S RULES

The rules of conduct in force at any given time, FamFit’s rules and instructions given by FamFit’s staff must always be followed. Violation of this may result in expulsion. Racist or condescending statements will result in immediate expulsion. FamFit may in special cases require the presentation of a medical certificate if it is assessed that the training may be harmful to the member’s health.

§18 EXCLUSION OF A MEMBER

FamFit may terminate any membership agreement without further notice. In the event of FamFit’s termination, unused prepayments will be refunded. If FamFit terminates a membership agreement due to a member’s material breach of the applicable membership conditions or rules of conduct, no refund of any kind will be made. Substantial breach is considered to include doping and racist statements.

§19 IMAGES AND VIDEO

As a FamFit member, you give FamFit permission to take pictures/video during FamFit’s trainings for use in FamFit’s marketing and online media. Pictures/video will be from a distance and to give an overall impression of the trainings. FamFit will try to avoid members being directly identifiable in the pictures unless consent is given. If you do NOT want to appear in FamFit’s pictures, please inform the individual instructor taking the picture/video (should it happen that you find yourself in a FamFit picture, please contact FamFit and we will immediately delete the picture/video).
